Pixum Photo Competition: "Colourful World"

1. The organizer of the competition is Diginet GmbH & Co. KG, Industriestraße 161, 50999 Cologne (hereafter "Pixum"). Participation in the contest is free of charge. The participation and the chances of winning do not depend in any way on the purchase of a product. The user accepts these terms and conditions. The participation is only possible through the way described in these conditions of participation. The deadline for submission is Sunday, the 2th of September 2018, 23:59 PM. All decisions are final and not subject to legal appeal. The contest is not supported by Facebook and is not linked to Facebook.

2. All persons above the age of 18 are eligible to participate. Exempt are employees of Pixum as well as their cooperation partners. Minors and other persons limited in their legal capacity can only participate if the consent of the parents or of their legal guardian is given.

3. Pixum invites the participants to submit one or several photos related to "Colourful World" on Instagram with the hashtag #pixumworld.

4. The participant must be the sole creator and owner of any image submitted by him or her. The images must not violate the rights of others. The participant must have the consent of all persons visible on the picture, in the case of minors, the consent of their parents or legal guardian is necessary. In addition, the images may not constitute a violation of applicable laws.

5. The participants grant Pixum, free of charge and for unlimited time, the right to reproduce, duplicate, distribute, make publicly accessible and use the content provided by them within the scope of the competition for fundraising campaigns.

6. Besides the chance that the own picture will be exhibited, 3x100 EUR Pixum vouchers will also be raffled off among all participants.

8. A payout in cash, exchange, transfer or reassignment of the prize to other people is not possible. Pixum reserves the right to offer an alternative prize of equal or higher value to the winners, if a published prize is not available for any reason. Pixum reserves the right to discontinue, suspend, postpone, or modify the contest in whole or in part without notice, in the event of unforeseen circumstances beyond Pixum's circle of influence which could jeopardize the scheduled contest. Pixum does not assume any responsibility or liability in that event.

9. The first name and the first letter of the surname and the place of residence of the winners may be published on the Pixum website, the official Facebook pages, the official Twitter channel and the official Instagram page of Pixum.

10. The liability of Pixum for damages resulting from injury to life, body or health which are based on a negligent or intentional breach of duty by Pixum, legal representatives or vicarious agents of Pixum, as well as damages resulting from intentional or grossly negligent breach of duty or fraudulent intent of Pixum, legal representatives or vicarious agents of Pixum shall remain unaffected. The same applies to damages which are covered by the Product Liability Act or from any guarantees assumed by Pixum.

11.Pixum is only liable to the damages, foreseeable in the contract, like for damages which are caused by a slightly negligent violation of contractual obligations of a legal representative or vicarious agent of Pixum and which do not affect life, health or body or claims according to the Product Liability Act. Contractual obligations are obligations whose fulfillment make the performance of the competition possible in the first place. Participants may rely on their compliance.

12. Pixum shall not be liable for damages, regardless of the legal grounds, which are not covered by the two preceding paragraphs.

Scope, purpose and duration of data processing

If you take part in the competition, following data will be processed:

• E-Mail,
• Title,
• First name,
• Last name,
• Date of birth,
• Instagram account name

We process the personal data of participants to carry out the competition, among other things to determine whether they are eligible to participate and to determine and notify the winners by E-Mail. If you do not provide us with the above data, we will not be able to participate in the competition or contact you with regard to a notification of a prize.

If you win, we will also ask you for the following information: Address. Your name and your address data, which we request from you by E-Mail in the event of a prize notification, serve to send the prize and to agree on the publication of your image. If you do not provide us with the above data, it is not possible to send and publish the prize. After the end of the competition your processed data within the scope of the campaign will be deleted within 60 days.

The data processing serves exclusively the purpose of the execution of the action. The legal basis for the processing of personal data to fulfil this obligation is therefore Art. 6 para. 1 letter b of the EU Data Protection Ordinance (DSGVO).

Recipient of Personal Data
In the event of a material prize, the participant data will be passed on to the mail-order company commissioned with the delivery, insofar as this is necessary for the delivery of the prize. Personal data will not be transferred to third parties or used for other advertising purposes without consent, unless we are legally obliged to surrender data or unless we engage third parties who are obliged to maintain professional secrecy in order to enforce our claims.

As far as Diginet GmbH & Co.
